As used throughout these Terms of Service, the following terms have the meanings set forth below:
1.1 "Website" means the website located at RadiologyJobs.com and all associated subdomains, web pages, mobile-optimized versions, and any successor URLs operated by Radiology Jobs, LLC.
1.2 "Services" means all services made available through the Website, including but not limited to job posting, candidate search, resume submission, job alert notifications, messaging features, AI-powered search tools, and any other features or functionality offered by Radiology Jobs, LLC, whether free or paid.
1.3 "Company," "we," "us," or "our" means Radiology Jobs, LLC, a Georgia limited liability company with its principal mailing address at PO Box 5735, Thomasville, GA 31758.
1.4 "User," "you," or "your" means any individual or entity that accesses or uses the Website or Services in any manner, including without limitation as a visitor, registered user, Member, Employer, or Candidate.
1.5 "Account" means the registered user account created by a User to access password-protected or personalized features of the Services.
1.6 "Content" means all text, data, information, images, graphics, audio, video, resumes, job postings, listings, messages, reviews, and any other materials submitted to, posted on, displayed through, or transmitted via the Website or Services, whether by Users or by the Company.
1.7 "Member" means a User who has registered for an Account and, where applicable, has subscribed to a paid Membership Plan.
1.8 "Employer" means a User—including a company, organization, staffing agency, hospital system, or other entity—that accesses or uses the Services for the purpose of posting job listings, searching candidate profiles, or otherwise recruiting or hiring candidates.
1.9 "Candidate" or "Job Seeker" means a User who accesses or uses the Services for the purpose of searching for employment opportunities, submitting resumes, applying to job listings, or otherwise seeking employment.
1.10 "Membership Plan" means a paid subscription tier that grants an Employer or other User access to enhanced or premium features of the Services for a defined billing period, as described at the time of purchase or on the Company’s pricing pages.
1.11 "Terms" means these Terms of Service, together with our Privacy Policy and any other policies, guidelines, or agreements incorporated herein by reference, each as amended from time to time.
1.12 "United States" means the fifty (50) states of the United States of America, the District of Columbia, and all U.S. territories and possessions, including Puerto Rico, Guam, the U.S. Virgin Islands, American Samoa, and the Northern Mariana Islands.
2.1 Agreement to Terms. These Terms constitute a legally binding agreement between you and Radiology Jobs, LLC governing your access to and use of the Website and Services. By taking any of the following actions, you acknowledge that you have read, understood, and agree to be bound by these Terms:
• Accessing or browsing the Website;
• Creating an Account or registering as a Member;
• Clicking "I Agree," "Accept," "Sign Up," or any similar button or checkbox presented in connection with the Services;
• Submitting a resume, job posting, or other Content to the Website;
• Purchasing a Membership Plan or otherwise paying for any Services.
2.2 Capacity to Contract. By agreeing to these Terms, you represent and warrant that: (a) you are at least 18 years of age; (b) you have the legal capacity to enter into a binding contract; (c) if you are accepting these Terms on behalf of a company or other legal entity, you have the authority to bind that entity to these Terms; and (d) your use of the Services does not violate any applicable law or regulation.
2.3 No Modification Without Consent. The Services are offered to you only on the condition that you accept these Terms without modification. If you do not accept these Terms in their entirety, you may not access or use the Website or Services.
2.4 E-SIGN Act Compliance. Your electronic acceptance of these Terms—whether by clicking a button, checking a box, or continued use of the Services—constitutes your electronic signature and has the same legal force and effect as a handwritten signature, pursuant to the Electronic Signatures in Global and National Commerce Act (E-SIGN Act), 15 U.S.C. § 7001 et seq., and applicable state electronic signature laws.
2.5 U.S.-Only Services — Geographic Scope.
NOTICE: THE SERVICES ARE INTENDED SOLELY FOR USERS LOCATED IN THE UNITED STATES (INCLUDING ITS TERRITORIES AND POSSESSIONS). Job listings posted on the platform are for positions located in the United States. The Services are designed, operated, and directed exclusively at users within the United States.
(a) U.S.-Directed Service. RadiologyJobs.com is a U.S.-based employment platform. The Website, its content, and all job listings are directed exclusively to users in the United States. We make no representation that the Services are appropriate, available, or lawful for use in any jurisdiction outside the United States.
(b) International Access at Own Risk. Users who access or use the Services from outside the United States do so entirely at their own risk and on their own initiative. Such users are solely responsible for determining whether their access to and use of the Services complies with the laws and regulations of their local jurisdiction. We have no obligation to ensure that the Services comply with the laws of any jurisdiction outside the United States.
(c) Consent to U.S. Data Processing. By accessing or using the Services from outside the United States, you acknowledge and consent to the collection, transfer, processing, and storage of your information in the United States under U.S. law. U.S. privacy and data protection laws may differ from the laws of your home country. Your use of the Services constitutes your agreement to this processing.
(d) No Targeting of Non-U.S. Users. We do not knowingly target, market, or solicit users outside the United States. Any access to the Services from outside the United States is incidental, and these Terms are not intended to create any obligations under the laws of any foreign jurisdiction.
3.1 Right to Modify. We reserve the right to modify these Terms at any time, at our sole discretion. When we make material changes, we will update the "Last Updated" date at the top of this page. We may also, at our discretion, provide additional notice of material changes via email, banner notice on the Website, or other means.
3.2 Effect of Continued Use. Your continued access to or use of the Website or Services after any posted modification to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must discontinue your use of the Services and, if applicable, cancel your Membership Plan in accordance with Section 8.
3.3 Review Responsibility. It is your responsibility to review these Terms periodically. We encourage you to check this page whenever you use the Services.
4.1 Account Creation. Certain features of the Services require you to create an Account. When registering, you agree to provide accurate, current, and complete information and to keep that information updated. Providing false, misleading, or outdated information is grounds for immediate suspension or termination of your Account.
4.2 One Account Per User. Unless otherwise expressly permitted in writing by us, each individual or entity may maintain only one Account. Creating multiple Accounts to circumvent a suspension, access restrictions, or billing requirements is prohibited.
4.3 Account Credentials. You are solely responsible for maintaining the confidentiality of your Account credentials, including your username and password. You agree to: (a) choose a strong, unique password; (b) not share your credentials with any third party; (c) notify us immediately at [email protected] if you suspect unauthorized access to or use of your Account; and (d) ensure that you log out of your Account at the end of each session, particularly when using shared or public devices.
4.4 Account Responsibility. You are fully responsible for all activities that occur under your Account, whether or not you authorized them. We are not liable for any loss or damage arising from your failure to maintain the security of your Account credentials.
4.5 Account Termination by Company. We reserve the right to suspend, restrict, or permanently terminate your Account and access to the Services at any time, with or without prior notice, if we reasonably determine that: (a) you have violated these Terms; (b) your Account has been used for fraudulent, abusive, or unlawful activity; (c) your Account has been dormant for an extended period; or (d) termination is necessary to protect the Services, other users, or third parties. Termination of a paid Membership Plan is subject to the cancellation and refund terms in Section 8.
4.6 Account Termination by User. You may close your Account at any time by contacting us at [email protected]. Closing your Account does not entitle you to a refund of any prepaid fees except as expressly set forth in Section 8. Upon closure, your right to access the Services will terminate, though certain provisions of these Terms will survive as noted herein.
5.1 Grant of License. Subject to your compliance with these Terms and, where applicable, payment of applicable fees, we grant you a limited, personal, non-exclusive, non-sublicensable, non-transferable, revocable license to access and use the Website and Services solely for their intended purposes: (a) for Candidates, to search for and apply to employment opportunities; and (b) for Employers, to post job listings and search for and contact qualified candidates in the radiology and medical imaging field.
5.2 Scope of License. This license is not a sale of any rights in or to the Website or Services. Except as expressly permitted under these Terms or with our prior written consent, you may not:
(a) copy, reproduce, distribute, republish, download, display, post, or transmit any portion of the Website or Services in any form or by any means;
(b) modify, adapt, translate, create derivative works of, or reverse engineer any portion of the Website, Services, or underlying software;
(c) license, sell, rent, lease, transfer, assign, or otherwise commercialize any portion of the Website or Services or your rights under this license;
(d) use the Website or Services for any purpose other than the purpose for which they are made available;
(e) access or use the Website or Services in any manner that could disable, damage, overburden, or impair the Website or its servers, or interfere with any other party’s use of the Services;
(f) remove, alter, or obscure any copyright, trademark, or other proprietary notice contained in or on the Website or Services.
5.3 SaaS Nature of Services. The Services are provided as a software-as-a-service (SaaS) platform. We retain all rights, title, and interest in and to the Website, Services, and all technology, software, databases, and systems underlying them. Nothing in these Terms transfers any ownership interest to you.
5.4 Reservation of Rights. All rights not expressly granted in this Section 5 are reserved by us. Any unauthorized use of the Website or Services automatically terminates the license granted herein.
6.1 General Obligation. You are solely responsible for ensuring that your use of the Website and Services complies with all applicable local, state, and federal laws and regulations, including without limitation employment laws, equal opportunity laws, anti-discrimination laws, and applicable EEOC regulations. You may use the Services only for lawful purposes.
6.2 Prohibited Conduct — Content. In connection with your use of the Services, you may not post, upload, submit, transmit, or otherwise make available any Content that:
(a) is false, misleading, inaccurate, fraudulent, or deceptive;
(b) is unlawful, harmful, threatening, abusive, harassing, defamatory, libelous, obscene, pornographic, vulgar, hateful, racially or ethnically offensive, or otherwise objectionable;
(c) infringes or violates any intellectual property right, privacy right, right of publicity, or other proprietary right of any person or entity;
(d) you do not have the right to reproduce, display, or transmit under any applicable law or contractual obligation (including nondisclosure or confidentiality agreements);
(e) contains any virus, trojan horse, worm, malware, ransomware, spyware, adware, or other harmful or disruptive code or component;
(f) constitutes unsolicited advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other unauthorized form of solicitation;
(g) contains any incomplete, false, or inaccurate resume or professional profile information, or information that purports to be a resume for a person other than a living individual seeking employment on their own behalf;
(h) advertises any franchise, pyramid scheme, multi-level marketing arrangement, distributorship, or other business opportunity that requires an upfront or recurring payment, pays commissions only without a significant base salary, requires recruitment of other members, or constitutes a similar arrangement; or
(i) deletes or alters any copyright notices, author attributions, legal notices, or proprietary labels.
6.3 Prohibited Conduct — System Integrity. You may not:
(a) use any automated tool, script, bot, spider, robot, scraper, crawler, data mining tool, or other automated means to access, collect, index, or extract data from the Website or Services without our prior written consent;
(b) use any device, software, or routine to interfere with or attempt to interfere with the proper functioning of the Website or any transaction conducted on the Website;
(c) impose an unreasonable or disproportionately large load on the Website’s infrastructure or servers;
(d) attempt to probe, scan, or test the vulnerability of the Website, its servers, or any associated network or systems, or to breach any security or authentication measures, without our express written authorization;
(e) access, tamper with, or use non-public areas of the Website, our computer systems, or the technical delivery systems of our service providers;
(f) attempt to decipher, decompile, disassemble, or reverse engineer any software comprising or making up any part of the Website or Services;
(g) forge any TCP/IP packet header or any part of the header information in any email or communication;
(h) use the Website or Services to develop, train, or improve any competing product, service, or database, or to derive or compile any commercially exploitable dataset from the Website’s Content;
(i) engage in or facilitate "screen scraping," "database scraping," or any other form of data aggregation without our prior written consent.
6.4 Prohibited Conduct — Accounts and Identity. You may not:
(a) impersonate any person or entity, including any Company employee or representative, or falsely state or misrepresent your identity or affiliation with any person or entity;
(b) share your Account credentials with any third party, or allow any third party to access the Services using your Account;
(c) access or attempt to access another user’s Account without authorization;
(d) create multiple Accounts for the same individual or entity without express written permission;
(e) use a false identity, fictitious employer name, or fictitious job listing.
6.5 Prohibited Conduct — Employer-Specific. Employers may not:
(a) post job listings for positions that do not actually exist or that are not bona fide employment opportunities;
(b) use candidate contact information obtained through the Services to solicit candidates for products or services unrelated to the posted job opportunity;
(c) use the Services in violation of the Americans with Disabilities Act (ADA), Title VII of the Civil Rights Act, the Age Discrimination in Employment Act (ADEA), or any other applicable employment discrimination law;
(d) post job listings that contain discriminatory language or requirements prohibited by applicable federal, state, or local law.
6.6 Prohibited Conduct — Candidate-Specific. Candidates may not:
(a) respond to any job listing for any purpose other than to apply for that specific employment opportunity;
(b) use the employer-facing features of the Services to solicit business from employers on behalf of a competitor of Radiology Jobs, LLC;
(c) submit resumes or applications on behalf of another person without that person’s express, informed consent.
6.7 Website Security Rules. Violations of system or network security may result in civil or criminal liability. We will investigate suspected violations and may cooperate with law enforcement authorities in prosecuting users involved in such violations. Security violations include, without limitation:
(a) accessing data not intended for you or logging into a server or Account that you are not authorized to access;
(b) attempting to interfere with service to any user, host, or network, including through flooding, mail-bombing, denial-of-service attacks, or crashing;
(c) sending unsolicited commercial email or other communications through or using our systems;
(d) introducing any unauthorized code, exploit, or vulnerability into the Website or Services.
6.8 Responsibility for Compliance. You acknowledge that you are solely responsible for ensuring that your use of the Services complies with these Terms and all applicable laws. The Services are designed for use within the United States. We do not warrant that the Services are appropriate or available for use outside the United States.
7.1 Your Ownership. As between you and us, you retain ownership of any Content you submit, post, upload, or otherwise transmit to the Website or Services, subject to the license grant in Section 7.2 below.
7.2 License Grant to Company. By submitting, uploading, or otherwise providing any Content to the Website or Services, you grant Radiology Jobs, LLC a royalty-free, worldwide, perpetual, irrevocable, non-exclusive, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, perform, display, and create derivative works from such Content (in whole or in part) in connection with operating, improving, and promoting the Website and Services, in any media or format now known or later developed. This license includes the right to share your Content with our service providers, affiliates, and business partners solely as necessary to provide or improve the Services.
7.3 Waiver of Moral Rights. To the extent permitted by applicable law, you waive any moral rights or rights of attribution in any Content you submit to the Website.
7.4 Your Representations Regarding Content. By submitting Content to the Website, you represent and warrant that: (a) you own the Content or have all necessary rights, licenses, consents, and permissions to grant the license in Section 7.2; (b) the Content does not violate any third-party intellectual property right, privacy right, or other proprietary right; (c) the Content is accurate and not misleading; and (d) the Content complies with these Terms and all applicable laws.
7.5 Company’s Right to Review and Remove Content. We reserve the right—but assume no obligation—to review, screen, monitor, edit, refuse to post, or remove any Content that, in our sole discretion, violates these Terms, is objectionable, or is otherwise inappropriate. We are not responsible for any failure or delay in removing such Content. Nothing in these Terms obligates us to store, maintain, or make available any Content you submit.
7.6 No Endorsement. The Content submitted by Users does not reflect the views or opinions of Radiology Jobs, LLC. We do not endorse, verify, or make any representations regarding the accuracy, reliability, or completeness of any user-submitted Content, including job postings, resumes, or employer representations.
7.7 Feedback. If you provide us with any feedback, suggestions, ideas, or recommendations regarding the Website or Services ("Feedback"), you grant us a royalty-free, perpetual, irrevocable, worldwide license to use, incorporate, and commercialize such Feedback without any obligation to you.
8.1 Overview of Membership Plans. We offer Membership Plans that provide Employers and other eligible Users with access to premium features of the Services. Available Membership Plans, their features, and their pricing are described on the Website’s pricing pages, which we may update from time to time. All Membership Plan fees are stated in U.S. dollars.
8.2 Payment Processing. All payments for Membership Plans are processed by Stripe, Inc. ("Stripe"), a third-party payment processor. When you provide your payment information, it is transmitted directly to and stored by Stripe. We do not store your full credit card number, CVV, or other raw payment card data on our systems. We store only the Stripe customer identifier and subscription identifier associated with your Account. By purchasing a Membership Plan, you agree to Stripe’s Terms of Service and Privacy Policy, available at stripe.com.
8.3 Billing and Charges. By purchasing a Membership Plan, you authorize us to charge the payment method on file with Stripe for the applicable fees. You represent and warrant that: (a) you have the legal right to use the payment method provided; (b) the billing information you provide is accurate and complete; and (c) you will promptly update your payment information if it changes.
8.4 Auto-Renewal Disclosure.
IMPORTANT — AUTOMATIC RENEWAL NOTICE: Your Membership Plan will automatically renew at the end of each billing period (monthly or as otherwise specified at time of purchase) at the then-current subscription rate, unless you cancel before the renewal date in accordance with Section 8.6. By purchasing a Membership Plan, you expressly authorize us to charge your payment method on file for each renewal period without further action from you. This auto-renewal feature applies to all Membership Plans unless otherwise stated.
We will charge the renewal fee to the same payment method used for your initial purchase (or any updated payment method you have on file). You are responsible for ensuring that your payment method remains valid. If a renewal charge fails, your access to premium features may be suspended or downgraded.
8.5 Price Changes. We reserve the right to change Membership Plan pricing at any time. We will provide you with at least thirty (30) days’ advance notice of any price increase applicable to your active Membership Plan, either by email to your registered email address or by notice on the Website. Your continued use of the Membership Plan after the effective date of a price change constitutes your acceptance of the new pricing. If you do not agree to the price change, you must cancel your Membership Plan before the next renewal date in accordance with Section 8.6.
8.6 Cancellation.
(a) How to Cancel: To cancel your Membership Plan and stop future auto-renewal charges, you must submit a written cancellation request before the start of your next billing cycle. Cancellation requests may be submitted by: (i) email to [email protected], with "Membership Cancellation" in the subject line; or (ii) such other cancellation method as we may make available on the Website from time to time.
(b) Effective Date of Cancellation: Your cancellation will take effect at the end of the current billing period. You will retain access to the paid features of your Membership Plan through the end of the period for which you have already been charged.
(c) Cancellation Deadline: Cancellation requests received after the start of a new billing cycle will not prevent the charge for that billing period from being processed, but will prevent renewal in subsequent billing periods.
(d) No Cancellation by Non-Use: Non-use of the Services, failure to log in, or inactivity does not constitute cancellation. You remain responsible for all charges until you submit a valid cancellation request as described above.
8.7 Refund Policy. Except as required by applicable law, all sales are final and no refunds will be issued for any Membership Plan fees, whether for partial billing periods, unused time on an active plan, or otherwise. If you believe a charge was made in error, please contact us at [email protected] within thirty (30) days of the disputed charge, and we will review your claim in good faith.
8.8 Delinquent Accounts. If any payment due from you is not received when due, your Account may be suspended or downgraded at our discretion. Any overdue balance will accrue a finance charge of 2.5% per month (or the maximum rate permitted by applicable law, whichever is lower) from the due date until paid in full. You authorize us, in our sole discretion, to charge any outstanding balance to a payment method we have on file for your Account. We reserve the right to pursue any and all available legal remedies to collect delinquent amounts, including referral to a collections agency or initiation of legal proceedings. You agree to pay all costs of collection, including reasonable attorneys’ fees.
8.9 Taxes. You are responsible for all applicable taxes, levies, or duties associated with your purchase of a Membership Plan, excluding taxes based on our net income. If we are required by law to collect taxes on amounts payable to us, we will add such taxes to the applicable fees.
8.10 Free Trials and Promotions. From time to time, we may offer free trials or promotional pricing for Membership Plans. Any such offers will be subject to additional terms communicated at the time of the offer. Unless we state otherwise, free trials will automatically convert to paid Membership Plans at the applicable rate at the end of the trial period, subject to the auto-renewal provisions of Section 8.4.
9.1 Agency Representation. Advertising agencies that represent clients in connection with the purchase of Services agree to accurately and professionally represent Radiology Jobs, LLC and its Services to their clients at all times.
9.2 Commissions. Recognized advertising agencies are eligible to receive commissions on qualifying purchases of our products and Services. Commission rates and eligibility criteria are established by us from time to time and communicated to approved agencies.
9.3 Commission Forfeiture. Agency commissions will be automatically forfeited on any invoice not paid in full within 75 days of the invoice date.
9.4 Dual Liability. Advertising agency clients and their agencies each accept joint and several liability for all insertion orders placed through the agency. Both the agency and the underlying client are responsible for ensuring timely payment.
9.5 Delinquent Agency Accounts. If an advertising agency account becomes delinquent, we reserve the right to contact the individual job-posting clients served by that agency for the purpose of collection and to require that those clients deal directly with us going forward.
10.1 Company Ownership. The Website and Services, including all Content created or provided by us (as opposed to user-submitted Content), and all software, databases, technology, algorithms, designs, logos, trademarks, service marks, trade names, graphics, text, and other materials comprising the Website and Services, are owned by or licensed to Radiology Jobs, LLC and are protected by U.S. copyright, trademark, patent, trade secret, and other intellectual property laws.
10.2 No Implied License. Nothing in these Terms grants you any right, title, or interest in our intellectual property beyond the limited license expressly set forth in Section 5. All rights not expressly granted are reserved.
10.3 Trademarks. "RadiologyJobs.com," "Radiology Jobs," and related logos and marks are trademarks and service marks of Radiology Jobs, LLC. You may not use our trademarks without our prior written consent. Nothing in these Terms grants you any right to use our trademarks or trade names.
10.4 Copyright Complaints. If you believe that any Content on the Website infringes your copyright, please contact us at [email protected] with a description of the allegedly infringing material, your contact information, and a statement of your good-faith belief that the use is not authorized by the copyright owner. We will review valid complaints and respond in accordance with applicable law.
10.5 Proprietary Notices. The deletion, alteration, or obscuring of any copyright, trademark, or other proprietary notice on the Website or in any Content we provide is strictly prohibited.
11.1 Third-Party Links. The Website may contain hyperlinks or other connections to websites, platforms, or services operated by third parties, including Member companies, advertising clients, and other organizations ("Third-Party Sites"). We do not own, operate, or control Third-Party Sites and are not responsible for their content, availability, accuracy, privacy practices, or security. Our inclusion of a link to a Third-Party Site does not imply any endorsement of the materials on that site or any association with its owners or operators.
11.2 Third-Party Services. The Services are integrated with various third-party technology providers (including payment processors, analytics providers, and others described in our Privacy Policy). Your use of Services involving third-party integrations may be subject to those third parties’ own terms of service and privacy policies, which you are responsible for reviewing.
11.3 Third-Party Conduct. We take no responsibility for the activities, conduct, information, or practices of any Member, job applicant, Employer, Candidate, advertiser, or other third party that uses or interacts with the Services. Nothing in these Terms constitutes a representation or warranty with respect to any third party’s Website, products, services, or practices.
11.4 Advertising and Cookies. We may permit third-party advertising services, including Google, to display advertisements on the Website. Such third-party advertisers may use cookies, pixel tags, and similar technologies to serve personalized advertisements based on your visits to the Website and other sites. You may opt out of interest-based advertising by visiting the applicable third-party opt-out pages (e.g., the Google Ads settings page or the Network Advertising Initiative opt-out tool). For more information about our use of cookies, please refer to our Privacy Policy.
12.1 No Monitoring Obligation. We are under no obligation to monitor, review, or moderate Content posted or transmitted through the Services. However, we reserve the right—in our sole discretion—to monitor any Content for the purposes of: (a) complying with applicable laws, regulations, or governmental requests; (b) operating and protecting the Website and Services; (c) ensuring compliance with these Terms; and (d) any other purpose we deem reasonably necessary.
12.2 Right to Act on Content. We reserve the right to modify, reject, remove, or disable access to any Content that, in our sole discretion, we believe violates these Terms, violates applicable law, or is otherwise harmful, offensive, or objectionable. We may take such action without prior notice and without liability to you or any third party.
12.3 Cooperation with Law Enforcement. We cooperate fully with law enforcement authorities and may disclose information about users, their Accounts, and their use of the Services as required or permitted by applicable law, legal process, or governmental request.
13.1 Privacy Policy. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, located at radiologyjobs.com/page/privacy-policy/, which is incorporated into these Terms by reference. By using the Services, you acknowledge that you have read and understand our Privacy Policy.
13.2 Nature of Data Collection. The nature of the Services requires that we collect, process, use, and distribute information you provide directly (such as your name, address, email address, and resume) as well as information generated by your use of the Services (such as search history and activity logs). Please review our Privacy Policy for full details.
13.3 No Guarantee of Confidentiality. While we implement reasonable security measures, we cannot guarantee that your information will be completely secure from unauthorized access. You acknowledge this inherent risk of providing information online.
13.4 Data Removal Requests. If you have submitted personal information to the Website and wish to request its removal from our systems, please contact us at [email protected] or at the contact information in Section 21. We will use commercially reasonable efforts to delete your information from our then-existing files, subject to applicable legal retention obligations and operational requirements.
14.1 Consent to Electronic Communications. By creating an Account or using the Services, you consent to receive communications from us electronically, including by email, push notification, or posting notices on the Website. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing, to the extent permitted by applicable law.
14.2 Promotional Communications. You may receive promotional emails, newsletters, or other marketing communications from us if you have opted in. You may opt out of promotional communications at any time by clicking the "unsubscribe" link in any such email or by contacting us at [email protected]. Opting out of promotional communications will not affect transactional or administrative communications related to your Account.
14.3 SMS / Text Message Program.
(a) Program Description. Radiology Jobs, LLC operates an SMS program that sends job alert text messages and related notifications to Candidates who have opted in to receive text messages. Message frequency may vary. Participation in the SMS program is optional and is not a condition of using the Services or receiving any other goods or services from us.
(b) How to Enroll. You may enroll in the SMS program by following the opt-in instructions presented on the Website or in the Services. By opting in, you consent to receive recurring automated text messages from or on behalf of Radiology Jobs, LLC at the mobile number you provide.
(c) How to Opt Out. You may opt out of the SMS program at any time by replying STOP, CANCEL, END, QUIT, or UNSUBSCRIBE to any text message you receive from us. After we receive your opt-out request, we will send you a one-time confirmation message, and you will not receive further SMS messages from us unless you re-enroll.
(d) Help. For assistance with the SMS program, reply HELP to any text message or contact us at [email protected].
(e) Message and Data Rates. Standard message and data rates may apply. Please consult your mobile carrier for details.
(f) Supported Carriers. Our SMS program is available through most major U.S. wireless carriers. Carrier availability may change without notice.
(g) No Liability for Delivery. We are not liable for delays or failures in the delivery of any SMS message. Delivery is subject to effective transmission from your network operator and is outside our control.
15.1 Overview of AI-Powered Services. Radiology Jobs, LLC offers AI-powered features as part of the Services to help Candidates discover relevant employment opportunities and to improve the overall job search experience. These features are described in this Section 15. By accessing or using any AI-powered feature, you acknowledge and agree to the terms and conditions set forth in this Section in addition to all other applicable provisions of these Terms. If you do not wish to use AI-powered features, you may continue to use the standard keyword-based search and browsing functionality of the Website.
15.2 Description of AI-Powered Services.
(a) AI Search. AI Search is an optional search feature that allows users to submit natural language queries to find relevant job listings. Unlike traditional keyword-based search, AI Search uses semantic understanding to interpret the meaning and context of your query — for example, "remote interventional radiology jobs on the West Coast with a signing bonus" — and returns job listings ranked by relevance to that meaning. AI Search combines semantic similarity scoring with traditional keyword matching to produce results.
(b) AI Recruiter (AI Chat). AI Recruiter is an optional conversational assistant that allows Candidates to conduct an interactive, back-and-forth dialogue to discover and refine job search results. Users may ask questions, provide follow-up context, and receive conversational responses that include job recommendations, explanations, and guidance. AI Recruiter understands context from earlier messages within a single session to improve the relevance of its responses.
(c) AI Profile Building — CV Processing Disclosure. When you upload a resume or CV to RadiologyJobs.com, we use artificial intelligence tools — including services provided by Anthropic PBC — to automatically parse and extract structured professional information from your document. This processing occurs automatically upon upload to help build your candidate profile and improve matching with relevant job opportunities.
The AI processing of your resume or CV involves two sequential passes: (i) a first pass to extract structured professional data from the document (as further described in Section 15.3(f)); and (ii) a second pass to generate career-level inferences, such as career stage, career trajectory, and subspecialty focus, to further populate and enrich your candidate profile. Where AI extraction produces a result, a confidence score may be associated with that result to reflect the system’s degree of certainty in the extracted or inferred value.
AI-extracted and AI-inferred profile data may be used to automatically populate empty fields in your candidate profile ("AI-Auto-Populated Data"). AI-Auto-Populated Data is subject to the accuracy disclaimer described in Section 15.3(g). This automated processing is subject to your consent as described in Section 15.5(g), and to the data retention practices described in our Privacy Policy at radiologyjobs.com/page/privacy-policy/.
15.3 How AI Features Work — User-Facing Explanation. When you use AI Search or AI Recruiter, your input is processed by automated systems and third-party artificial intelligence services to generate results. Specifically:
(a) Your search query or chat message is analyzed to determine your intent and extract relevant search parameters such as job specialty, location, employment type, and compensation preferences.
(b) Your query is converted into a mathematical representation (a "vector embedding") that captures its semantic meaning, which is then compared against similar representations of job listings in our database to identify the most relevant matches.
(c) Results are ranked and, in some cases, further refined using additional AI-assisted ranking processes to improve relevance.
(d) For AI Recruiter, conversational responses are generated by large language models and returned to you to explain or contextualize the job results or to answer general job search questions.
(e) All results remain subject to the underlying job listings available on the Website at the time of your search. AI ranking improves the ordering and relevance of results but does not create, modify, or guarantee the existence of any particular job opportunity.
(f) CV Processing — Extraction Pass. When you upload a resume or CV, the document is submitted to AI processing in a first pass designed to identify and extract structured professional information from your document. The categories of information that the AI system may attempt to extract include, but are not limited to: employment history, educational background, clinical training, professional certifications, and credentials as described in your document. This extraction is automated and may be incomplete or imprecise; we do not represent or warrant that all information present in your document will be detected or accurately captured. RadiologyJobs.com does not independently verify the credentials, certifications, or other professional information extracted from your document.
(g) CV Processing — Inference Pass and Profile Auto-Population. Following the initial extraction pass, a second AI processing pass may be applied to generate career-level inferences derived from the extracted data. These inferences may include assessments of career stage, career trajectory, and subspecialty focus, and may carry associated confidence scores reflecting the degree of certainty in each inference. These inferences are generated automatically and are not reviewed by a human representative of Radiology Jobs, LLC prior to being used to populate your profile.
AI-Auto-Populated Data derived from the extraction and inference passes described above may be used to automatically fill empty fields in your candidate profile. AI-Auto-Populated Data will not overwrite information that you have manually entered into your profile. The presence of AI-Auto-Populated Data in your profile does not constitute a representation by Radiology Jobs, LLC as to its accuracy or completeness, and you remain solely responsible for the accuracy of your profile as presented to employers.
AI-extracted profile data is subject to the data retention practices described in our Privacy Policy at radiologyjobs.com/page/privacy-policy/.
15.4 AI-Generated Content — Informational Purposes Only.
(a) Not Professional Advice. AI-generated responses, suggestions, recommendations, and other outputs produced by AI Recruiter and AI Search (collectively, "AI Outputs") are provided for informational and convenience purposes only. AI Outputs do not constitute professional career advice, legal advice, employment counsel, or any other form of professional guidance. You should not rely on AI Outputs as a substitute for independent professional judgment.
(b) Potential for Error. AI Outputs are generated by probabilistic machine learning systems and may contain inaccuracies, omissions, misinterpretations, or errors. AI systems may misunderstand ambiguous queries, produce outdated information, or generate responses that do not accurately reflect the current state of the job market or any specific employer’s requirements.
(c) No Endorsement of Results. The appearance of a job listing in AI Search results or in an AI Recruiter recommendation does not constitute an endorsement by Radiology Jobs, LLC of that employer, the job opportunity, the accuracy of the listing, or the suitability of the position for you. You are solely responsible for independently evaluating any job listing and any employer before applying or making any employment-related decision.
(d) Human Review Recommended. We strongly encourage you to exercise independent judgment and conduct your own due diligence with respect to any job opportunity identified through AI features. Employment decisions are significant and should not be made solely on the basis of AI-generated outputs.
15.5 User Responsibilities When Using AI Features.
(a) Appropriate Use. You agree to use AI features only for their intended purpose: searching for radiology and medical imaging employment opportunities and obtaining related job search information. AI features are not designed or intended for any other purpose.
(b) Limit Sensitive Information. You should not include in any AI Search query or AI Recruiter conversation any sensitive personal information beyond what is reasonably necessary to conduct a job search. In particular, you should avoid submitting through AI features: Social Security numbers, government-issued identification numbers, financial account information, protected health information (PHI) or other medical or biometric data, immigration status, information about minor children, or any information whose disclosure could expose you to identity theft, discrimination, or other harm. We do not request or require this type of sensitive information to use AI features, and any such information you voluntarily include in a query or chat message will be processed by our AI systems and third-party AI service providers as described in Section 15.8.
(c) No Manipulation or Circumvention Attempts. You may not attempt to manipulate, deceive, "jailbreak," override, or circumvent the AI systems’ content guidelines or operational constraints, including by: crafting inputs designed to cause the AI to ignore its instructions; attempting to extract the AI system’s underlying prompts, training data, or model parameters; submitting inputs designed to produce outputs that violate these Terms or applicable law; or engaging in adversarial prompt injection or similar techniques. Violation of this subsection may result in immediate suspension of your access to AI features or your Account.
(d) Independent Evaluation. You agree not to rely solely on AI Search results or AI Recruiter recommendations when making employment decisions. You are solely responsible for independently verifying the accuracy, currency, and completeness of any information obtained through AI features before acting on it.
(e) No Automated Extraction of AI Outputs. You may not use automated tools, scripts, bots, or other programmatic means to systematically collect, harvest, or store AI Outputs in bulk. This prohibition supplements the general prohibition on automated data collection in Section 6.3.
(f) Truthful Inputs. You agree to provide truthful, accurate information in your AI Search queries and AI Recruiter conversations. Submitting false, misleading, or fraudulent information through AI features may impair the quality of results and may violate Section 6.2.
(g) Consent to CV Processing. By uploading a resume or CV to RadiologyJobs.com, you consent to the automated AI processing of that document as described in these Terms and our Privacy Policy. We are working to provide enhanced in-app disclosures at the point of upload to give you greater transparency and control over AI processing of your documents.
15.6 Conversation Data and Session History.
(a) Session-Based Context. AI Recruiter maintains a limited history of your conversation — specifically, up to the last ten (10) messages exchanged within a single session — for the purpose of providing contextually relevant responses. This conversation history allows AI Recruiter to understand follow-up questions, remember preferences you have expressed earlier in the session, and refine job recommendations without requiring you to repeat yourself.
(b) Data Retention and Use. Conversation content, including your messages and AI Outputs, may be logged and retained by us for purposes including: (i) debugging and quality assurance; (ii) monitoring compliance with these Terms; (iii) improving and training our AI systems and features; (iv) analytics and service performance measurement; and (v) complying with legal obligations. For further information about how we handle conversation data, including your rights with respect to personal data under applicable U.S. privacy laws, please refer to our Privacy Policy at radiologyjobs.com/page/privacy-policy/.
(c) Feedback. AI Recruiter may offer you the opportunity to submit feedback (such as ratings or comments) about the quality of AI responses. Any feedback you submit is governed by Section 7.7 of these Terms and may be used to improve AI features. Feedback submission is voluntary.
(d) Search Analytics. When you use AI Search or AI Recruiter, we collect analytics data about your search session, which may include: your original query text; an AI-reformulated version of your query; search filters applied; your user ID (if logged in); your user type (Candidate, Employer, or guest); the number of results returned; relevance scores associated with results; processing time; and the timestamp of your search. This data is used to measure and improve AI feature performance.
15.7 Content Guardrails and Scope Limitations.
(a) Job Search Scope. AI features are designed and configured to assist with radiology and medical imaging job search tasks only. AI Recruiter will decline to respond to queries that are outside the scope of job searching on this platform, that request advice on topics unrelated to employment and job search (such as medical advice, legal advice, or financial planning), or that involve harmful, inappropriate, or prohibited content.
(b) Automatic Redirection. Queries that fall outside the permitted scope will receive a polite redirection message indicating that the feature is not designed to assist with that type of request. The redirection of an out-of-scope query does not constitute a failure of the Services.
(c) No Guarantee of Guardrail Efficacy. While we implement reasonable content moderation measures, we do not guarantee that AI features will detect and block all inappropriate or off-topic content in every instance. AI content guardrails are subject to the inherent limitations of automated content screening systems.
15.8 Third-Party AI Service Providers.
(a) Use of Third-Party AI Services. AI features are powered in part by third-party artificial intelligence services. By using AI features, you acknowledge and consent to the transmission of your inputs (search queries, chat messages, and related data) to the following categories of third-party service providers for the purpose of generating AI Outputs:
Google LLC (Google Cloud / Gemini API): Used to convert text to semantic embeddings, to parse and rewrite search queries, and to generate conversational responses in AI Recruiter. Google’s Privacy Policy is available at policies.google.com/privacy. Google’s AI usage policies are available at ai.google.dev/gemini-api/terms.
Pinecone Systems, Inc. (Pinecone): A cloud-hosted vector database used to store semantic representations of job listings and to perform similarity searches. Pinecone’s Privacy Policy is available at pinecone.io/privacy.
Cohere Inc. (Cohere): Used on an optional basis to perform re-ranking of search results for improved relevance. Cohere’s Privacy Policy is available at cohere.com/privacy. Cohere may receive your search query and job description text for re-ranking purposes.
Anthropic PBC (Claude): Used for automated CV and resume processing, including structured data extraction and career inference generation as described in Sections 15.2(c) and 15.3(f)–(g), and may also be used as a large language model provider for conversational response generation in AI Recruiter. Anthropic’s Privacy Policy is available at anthropic.com/privacy.
(b) Scope of Data Transmitted. Data transmitted to third-party AI service providers is limited to what is necessary to perform the specific AI functions described above. We do not intentionally transmit to AI service providers your full name, email address, payment information, or other directly identifying Account information as part of standard AI feature operation, though we cannot prevent you from voluntarily including such information in your queries or messages.
(c) Third-Party Data Practices. Each third-party AI service provider has its own privacy and data retention policies that govern how they process data received through our API integrations. We encourage you to review those policies. We are not responsible for the data practices of third-party AI service providers, except to the extent we have contractual protections in place with them. All third-party AI service providers used by us are U.S.-based companies. Data processed by these service providers in connection with the Services is handled in accordance with U.S. data protection standards and applicable federal and state privacy law, including the California Consumer Privacy Act (CCPA/CPRA) where applicable.
(d) Service Provider Updates. The third-party AI service providers listed in this Section 15.8 are current as of the Effective Date of these Terms. We may add, remove, or replace AI service providers at any time. Material changes to third-party AI service providers will be reflected in updates to these Terms or our Privacy Policy.
15.9 AI Features and Employment Law Compliance.
(a) Algorithmic Fairness. We take reasonable steps to monitor AI features for disparate impact and to mitigate known sources of bias in AI-generated job recommendations. However, we do not guarantee that AI Outputs are entirely free from bias, and algorithmic systems may reflect biases present in training data or historical patterns.
(b) Employer Independence. AI Search results and AI Recruiter recommendations are generated based on job listing content and your search parameters. All hiring decisions are made solely and independently by employers. Radiology Jobs, LLC does not participate in, direct, or influence any employer’s hiring decisions. No AI Output constitutes a guarantee, promise, or representation that you will receive a job offer, interview, or any other employment outcome.
(c) U.S. AI and Employment Law Compliance. We are committed to operating AI features in a manner consistent with applicable U.S. federal and state laws governing the use of AI and automated tools in employment contexts. Specifically:
(i) EEOC Guidance on AI. We are aware of the U.S. Equal Employment Opportunity Commission (EEOC) guidance on the use of AI and automated hiring tools in employment and endeavor to ensure that our AI features do not facilitate unlawful discrimination on the basis of race, color, religion, sex, national origin, age, disability, or genetic information, as prohibited by Title VII of the Civil Rights Act of 1964, the Age Discrimination in Employment Act (ADEA), the Americans with Disabilities Act (ADA), and other applicable federal anti-discrimination laws.
(ii) Title VII and Disparate Impact. We acknowledge that AI-assisted hiring tools may present disparate impact concerns under Title VII and the ADEA. We take reasonable steps to assess our AI features for potential disparate impact and to mitigate identified risks. Employers using the Services are independently responsible for ensuring that their use of AI-assisted hiring tools complies with applicable anti-discrimination laws and EEOC guidance.
(iii) Illinois AI Video Interview Act. To the extent applicable, employers using the Services in connection with candidates located in Illinois should be aware of the Illinois Artificial Intelligence Video Interview Act (820 ILCS 42/), which imposes requirements on employers using AI to analyze video interviews. Employers are solely responsible for their compliance with this law.
(iv) Colorado AI Act (SB 24-205). Employers interacting with candidates in Colorado should be aware of Colorado’s Artificial Intelligence Act (SB 24-205), which imposes obligations on developers and deployers of high-risk AI systems, including those used in employment decisions. Employers are solely responsible for their compliance with applicable Colorado law.
(v) NYC Local Law 144 on Automated Employment Decision Tools. Employers using the Services to evaluate candidates in New York City should be aware of NYC Local Law 144, which regulates the use of automated employment decision tools (AEDTs) in hiring and promotion decisions, including requirements for bias audits and candidate notification. Employers are solely responsible for their compliance with NYC Local Law 144 and any successor regulations.
(vi) Maryland and Other Emerging State Laws. Additional state laws governing the use of AI in employment contexts are emerging across the United States, including in Maryland and other jurisdictions. Employers are responsible for monitoring and complying with applicable state and local laws governing AI-assisted employment decisions in the jurisdictions where they operate.
(vii) FTC Enforcement. We acknowledge the Federal Trade Commission’s (FTC) authority to investigate and take action regarding unfair or deceptive practices related to AI systems and automated tools, including representations made about AI capabilities or fairness. We are committed to making accurate representations about the capabilities and limitations of our AI features, consistent with FTC guidance on AI and consumer protection.
(viii) Commitment to Non-Discrimination. We are committed to designing, testing, and operating AI features in a manner that does not produce outputs that unlawfully discriminate against users or candidates on the basis of protected characteristics under federal or applicable state law. Users who believe they have been adversely affected by an AI Output in a manner that may constitute unlawful discrimination are encouraged to contact us at [email protected].
(d) Notice of AI Interaction. When you use AI Recruiter, you are interacting with an automated AI system, not a human representative of Radiology Jobs, LLC. We will make reasonable efforts to ensure this is clear from the interface. If you prefer to interact with a human representative, please contact us at [email protected].
15.10 Availability, Modification, and Discontinuation of AI Features.
(a) No Guarantee of Availability. AI features are offered on an "as available" basis and are not guaranteed to be continuously available. AI features may be unavailable due to scheduled or unscheduled maintenance, technical failures, third-party service outages, high demand, or other factors within or outside our control.
(b) Right to Modify. We reserve the right to modify, update, limit, restrict, or change any aspect of AI features at any time and without prior notice, including by changing the underlying AI models, providers, or algorithms; adding or removing functionality; imposing usage limits; or otherwise adjusting AI feature behavior.
(c) Right to Discontinue. We reserve the right to suspend or permanently discontinue AI features, in whole or in part, at any time, with or without notice. Discontinuation of AI features does not affect the availability of other Services and does not entitle you to any refund of Membership Plan fees.
(d) Experimental Nature. AI features are subject to ongoing development and improvement. Results and capabilities may vary over time as underlying models and systems are updated. We make no warranty that AI features will perform consistently or that any particular level of service quality will be maintained.
15.11 No Guarantee of Job Search Results. AI Search results and AI Recruiter recommendations are generated to improve the relevance of job listings presented to you based on your query. However:
(a) AI Search does not guarantee that all relevant jobs are returned in any search, nor that the most relevant jobs are ranked first in every instance.
(b) The availability, accuracy, and currency of job listings are the sole responsibility of the employers who posted them. AI features do not verify, validate, or endorse the content of any job listing.
(c) Use of AI features does not increase or improve your likelihood of being hired, receiving an interview, or obtaining any other employment outcome. Employer decisions are entirely independent of our AI systems.
(d) AI features are not a substitute for professional job placement services, career counseling, or other employment assistance.
15.12 Intellectual Property in AI Outputs.
(a) Ownership of AI Outputs. AI Outputs generated through AI Recruiter and AI Search in response to your queries are produced by automated systems using a combination of our proprietary technology, third-party AI models, and publicly indexed job listing data. As between you and Radiology Jobs, LLC, we retain all rights, title, and interest in and to the AI systems, models, algorithms, and infrastructure that produce AI Outputs.
(b) Limited License to You. We grant you a limited, personal, non-exclusive, non-transferable license to view and use AI Outputs solely for your personal, non-commercial job search activities on the Website. You may not reproduce, distribute, publish, or commercialize AI Outputs, or use them to develop, train, or improve any competing product or AI system.
(c) No Claim on Your Inputs. We do not assert ownership of the search queries or chat messages you submit to AI features. However, by submitting such inputs, you grant us the rights described in Section 7.2 of these Terms, including the right to use your inputs to operate, improve, and train our AI systems, subject to our Privacy Policy.
(d) Third-Party Model IP. AI Outputs may be generated in part by third-party AI models. We make no representation or warranty regarding the ownership or originality of AI Outputs, and you assume all risk in relying on or using AI Outputs for any purpose.
16.1 "As Is" and "As Available" Basis. THE WEBSITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RADIOLOGY JOBS, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
(a) ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT;
(b) ANY WARRANTY THAT THE WEBSITE OR SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;
(c) ANY WARRANTY AS TO THE ACCURACY, COMPLETENESS, RELIABILITY, CURRENCY, OR QUALITY OF ANY CONTENT AVAILABLE ON OR THROUGH THE WEBSITE OR SERVICES, INCLUDING JOB POSTINGS AND CANDIDATE INFORMATION;
(d) ANY WARRANTY THAT THE SERVICES WILL MEET YOUR REQUIREMENTS OR THAT ANY PARTICULAR RESULT WILL BE ACHIEVED, INCLUDING THAT YOU WILL OBTAIN EMPLOYMENT OR HIRE A QUALIFIED CANDIDATE;
(e) ANY WARRANTY ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE.
NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM RADIOLOGY JOBS, LLC, ITS AFFILIATES, OR ANY OF THEIR RESPECTIVE EMPLOYEES OR REPRESENTATIVES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
16.1A AI-SPECIFIC DISCLAIMERS. IN ADDITION TO THE GENERAL WARRANTIES DISCLAIMER SET FORTH ABOVE, THE FOLLOWING SPECIFIC DISCLAIMERS APPLY TO ALL AI-POWERED FEATURES AND AI OUTPUTS:
(a) AI OUTPUTS PROVIDED "AS IS." AI OUTPUTS — INCLUDING ALL RESPONSES, RECOMMENDATIONS, JOB RANKINGS, AND OTHER CONTENT GENERATED BY AI SEARCH, AI RECRUITER, OR ANY OTHER AI-POWERED FEATURE — ARE PROVIDED STRICTLY "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RADIOLOGY JOBS, LLC EXPRESSLY DISCLAIMS ALL WARRANTIES WITH RESPECT TO AI OUTPUTS, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF:

(ii) COMPLETENESS — AI SEARCH RESULTS MAY NOT INCLUDE ALL RELEVANT JOB LISTINGS, AND AI RECRUITER RESPONSES MAY NOT REFLECT ALL AVAILABLE INFORMATION RELEVANT TO YOUR SEARCH;
(iii) FITNESS FOR A PARTICULAR PURPOSE — AI OUTPUTS ARE NOT TAILORED TO YOUR INDIVIDUAL CAREER GOALS, QUALIFICATIONS, MEDICAL LICENSURE STATUS, OR PERSONAL CIRCUMSTANCES, AND RADIOLOGY JOBS, LLC MAKES NO WARRANTY THAT AI OUTPUTS ARE SUITABLE FOR YOUR SPECIFIC NEEDS;
(iv) RELIABILITY OR CONSISTENCY — AI SYSTEMS ARE PROBABILISTIC IN NATURE AND MAY PRODUCE DIFFERENT OUTPUTS IN RESPONSE TO THE SAME OR SIMILAR INPUTS ON DIFFERENT OCCASIONS.
(b) NO WARRANTY OF FREEDOM FROM BIAS. RADIOLOGY JOBS, LLC DOES NOT WARRANT THAT AI OUTPUTS ARE FREE FROM ALGORITHMIC BIAS, STATISTICAL BIAS, OR OTHER FORMS OF SYSTEMATIC ERROR. AI SYSTEMS MAY REFLECT BIASES PRESENT IN TRAINING DATA, JOB LISTING CONTENT, OR HISTORICAL PATTERNS THAT COULD RESULT IN OUTPUTS THAT DISPROPORTIONATELY FAVOR OR DISFAVOR CERTAIN JOB TYPES, GEOGRAPHIC LOCATIONS, EMPLOYMENT ARRANGEMENTS, OR CANDIDATE PROFILES. YOU SHOULD INDEPENDENTLY EVALUATE AI SEARCH RESULTS AND AI RECRUITER RECOMMENDATIONS AND NOT RELY ON THEM AS OBJECTIVE OR BIAS-FREE ASSESSMENTS.
(c) NO LIABILITY FOR RELIANCE ON AI OUTPUTS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RADIOLOGY JOBS, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY LOSS, DAMAGE, HARM, OR ADVERSE OUTCOME ARISING FROM OR IN CONNECTION WITH YOUR RELIANCE ON AI OUTPUTS, INCLUDING BUT NOT LIMITED TO: (i) EMPLOYMENT DECISIONS (WHETHER TO APPLY TO, ACCEPT, OR DECLINE ANY JOB OPPORTUNITY) MADE IN RELIANCE ON AI RECOMMENDATIONS; (ii) HIRING DECISIONS MADE BY EMPLOYERS IN CONNECTION WITH THEIR USE OF THE SERVICES; (iii) CAREER OR FINANCIAL HARM RESULTING FROM ACTING OR FAILING TO ACT ON AI OUTPUTS; OR (iv) ANY PERSONAL OR PROFESSIONAL CONSEQUENCE OF AI OUTPUTS THAT WERE INACCURATE, INCOMPLETE, BIASED, OR MISLEADING.
(d) AI FEATURES AVAILABILITY DISCLAIMER. RADIOLOGY JOBS, LLC MAKES NO WARRANTY THAT AI FEATURES WILL BE CONTINUOUSLY AVAILABLE, UNINTERRUPTED, OR ERROR-FREE. AI FEATURES MAY BE TEMPORARILY UNAVAILABLE WITHOUT NOTICE DUE TO: (i) MAINTENANCE, UPDATES, OR UPGRADES TO OUR SYSTEMS OR THOSE OF THIRD-PARTY AI SERVICE PROVIDERS; (ii) OUTAGES, DEGRADATION, OR INTERRUPTIONS IN THIRD-PARTY AI SERVICE PROVIDER SERVICES; (iii) HIGH TRAFFIC OR COMPUTATIONAL DEMAND; (iv) TECHNICAL FAILURES WITHIN OR OUTSIDE OUR REASONABLE CONTROL; OR (v) OUR DECISION TO MODIFY, SUSPEND, OR DISCONTINUE AI FEATURES. TEMPORARY OR PERMANENT UNAVAILABILITY OF AI FEATURES DOES NOT CONSTITUTE A BREACH OF THESE TERMS OR ENTITLE YOU TO ANY REFUND OR CREDIT.
(e) THIRD-PARTY AI SERVICE PROVIDER DISCLAIMER. THIRD-PARTY AI SERVICE PROVIDERS (INCLUDING GOOGLE, PINECONE, COHERE, AND ANTHROPIC) MAY MODIFY, LIMIT, DEPRECATE, OR DISCONTINUE THEIR SERVICES OR CHANGE THEIR TERMS AND POLICIES AT ANY TIME AND WITHOUT ADVANCE NOTICE TO RADIOLOGY JOBS, LLC OR TO YOU. RADIOLOGY JOBS, LLC IS NOT RESPONSIBLE FOR ANY CHANGE IN AI FEATURE PERFORMANCE, CAPABILITY, OR AVAILABILITY RESULTING FROM ACTIONS TAKEN BY THIRD-PARTY AI SERVICE PROVIDERS. WE MAKE NO WARRANTY THAT ANY PARTICULAR THIRD-PARTY AI SERVICE PROVIDER WILL REMAIN AVAILABLE OR THAT THEIR SERVICES WILL CONTINUE TO MEET ANY PARTICULAR STANDARD OF QUALITY, SAFETY, OR PERFORMANCE.

AI FEATURES INCORPORATE MACHINE LEARNING AND GENERATIVE AI TECHNOLOGIES THAT ARE SUBJECT TO ONGOING DEVELOPMENT AND THAT MAY PRODUCE UNEXPECTED, INCONSISTENT, OR INCORRECT RESULTS. THE USE OF AI FEATURES IS AT YOUR OWN RISK. YOU ACKNOWLEDGE THAT AI TECHNOLOGY IS INHERENTLY IMPERFECT AND THAT YOU HAVE HAD AN ADEQUATE OPPORTUNITY TO EVALUATE THE APPROPRIATENESS OF AI FEATURES FOR YOUR PURPOSES BEFORE USING THEM.
16.2 Employment Outcomes. WE MAKE NO WARRANTY, REPRESENTATION, OR GUARANTEE THAT YOUR USE OF THE SERVICES WILL RESULT IN YOUR HIRING ANY CANDIDATE OR IN YOUR OBTAINING ANY EMPLOYMENT OR JOB OFFER. ALL SALES ARE FINAL. THE SUITABILITY OF ANY JOB POSTING OR CANDIDATE PROFILE IS YOUR SOLE RESPONSIBILITY TO EVALUATE.
16.3 Internet Risks. YOU ASSUME ALL RISK AND RESPONSIBILITY FOR YOUR USE OF THE WEBSITE, SERVICES, AND THE INTERNET GENERALLY. WE DO NOT GUARANTEE CONTINUOUS, UNINTERRUPTED, OR SECURE ACCESS TO THE SERVICES, AND THE OPERATION OF THE WEBSITE MAY BE AFFECTED BY NUMEROUS FACTORS OUTSIDE OUR CONTROL.
16.4 Limitation of Liability. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL RADIOLOGY JOBS, LLC OR ANY OF ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY:
(a) INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES;
(b) LOSS OF PROFITS, REVENUE, DATA, BUSINESS, GOODWILL, OR ANTICIPATED SAVINGS;
(c) LOSS OF OR DAMAGE TO CONTENT, DATA, OR INFORMATION;
(d) COST OF SUBSTITUTE GOODS OR SERVICES;
ARISING OUT OF OR IN CONNECTION WITH: (i) YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE WEBSITE OR SERVICES; (ii) ANY CONTENT OR CONDUCT OF ANY USER OR THIRD PARTY THROUGH THE SERVICES; (iii) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR ANY PERSONAL INFORMATION STORED THEREIN; OR (iv) ANY OTHER MATTER RELATING TO THE WEBSITE OR SERVICES — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY.
16.5 Aggregate Liability Cap. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE WEBSITE OR SERVICES, REGARDLESS OF THE FORM OF ACTION OR THE BASIS OF THE CLAIM, SHALL NOT EXCEED THE GREATER OF: (a) THE TOTAL FEES ACTUALLY PAID BY YOU TO RADIOLOGY JOBS, LLC IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (b) FIVE HUNDRED U.S. DOLLARS ($500.00).
16.6 Jurisdictional Limitations. BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITIES, THE EXCLUSIONS AND LIMITATIONS IN THIS SECTION 16 MAY NOT APPLY TO YOU IN THEIR ENTIRETY. IN SUCH STATES, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
16.7 Essential Basis. YOU ACKNOWLEDGE THAT THE LIMITATIONS OF LIABILITY IN THIS SECTION 16 REFLECT A REASONABLE AND FAIR ALLOCATION OF RISK AND ARE AN ESSENTIAL ELEMENT OF THE BASIS OF THE BARGAIN BETWEEN YOU AND RADIOLOGY JOBS, LLC. THE WEBSITE AND SERVICES WOULD NOT BE PROVIDED TO YOU WITHOUT THESE LIMITATIONS.
17.1 Your Indemnification Obligation. You agree to defend, indemnify, and hold harmless Radiology Jobs, LLC and its officers, directors, members, employees, agents, licensors, service providers, and successors (collectively, the "Indemnified Parties") from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees and court costs) arising out of or relating to:
(a) your access to or use of the Website or Services;
(b) any Content you submit, post, upload, or transmit through the Website or Services;
(c) your violation of these Terms;
(d) your violation of any applicable law or regulation;
(e) your violation of any third-party right, including any intellectual property right, privacy right, or right of publicity; or
(f) any claim by a third party relating to employment decisions you made based on information obtained through the Services.
17.2 Indemnification Procedure. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you will cooperate fully with us in asserting any available defenses. You may not settle any claim against the Indemnified Parties without our prior written consent.
18.1 Informal Resolution. Before initiating any formal legal proceeding, you agree to attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms, the Website, or the Services ("Dispute") through good-faith informal negotiation. To initiate informal dispute resolution, you must send a written notice to us at [email protected] describing the nature of the Dispute and the relief sought. We will have thirty (30) days from receipt of such notice to respond and attempt to resolve the Dispute informally.
18.2 Mediation. If a Dispute is not resolved through informal negotiation within thirty (30) days (or such extended period as the parties may agree in writing), either party may request non-binding mediation before a single mediator mutually agreed upon by the parties. The costs of mediation shall be shared equally by the parties unless otherwise agreed.
18.3 Litigation. If a Dispute is not resolved through informal negotiation or mediation within sixty (60) days of the original written notice, either party may pursue its claims through litigation in the courts identified in Section 19.
18.4 No Class Actions. To the fullest extent permitted by applicable law, you agree that any Dispute will be resolved on an individual basis only. You waive any right to participate in a class action lawsuit, class-wide arbitration, or any proceeding in which you act or propose to act in a representative capacity, except where such waiver is prohibited by applicable law.
18.5 Equitable Relief. Notwithstanding the foregoing, either party may seek immediate injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm, without first exhausting the informal resolution process described above.
18.6 Statute of Limitations. To the extent permitted by applicable law, any claim arising under these Terms must be filed within one (1) year after the cause of action accrues, or such claim will be permanently barred.
19.1 Governing Law. These Terms and any Dispute arising out of or relating to these Terms, the Website, or the Services shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
19.2 Exclusive Venue. Subject to Section 18, any legal action or proceeding relating to these Terms, the Website, or the Services shall be brought exclusively in the federal or state courts of competent jurisdiction located in Thomasville or Thomas County, Georgia, United States of America. You hereby irrevocably consent to personal jurisdiction and venue in those courts and waive any objection to jurisdiction or venue in such courts, including any claim that such courts are an inconvenient forum.
19.3 Force Majeure. Neither party shall be liable for any delay or failure in performance (other than payment obligations) to the extent that such delay or failure is caused by events beyond that party’s reasonable control, including but not limited to: acts of God; natural disasters; pandemics or epidemics; acts of war, terrorism, or civil unrest; governmental actions, embargoes, or sanctions; labor disputes; power outages; internet or telecommunications infrastructure failures; or cyberattacks (each, a "Force Majeure Event"). The affected party shall: (a) promptly notify the other party in writing upon becoming aware of a Force Majeure Event; (b) use commercially reasonable efforts to mitigate the impact of and overcome the Force Majeure Event; and (c) resume full performance as soon as reasonably practicable. If a Force Majeure Event affecting us continues for more than thirty (30) consecutive days, you may cancel your Membership Plan with a pro-rated refund for the unused portion of the then-current billing period.
20.1 Entire Agreement. These Terms, together with our Privacy Policy and any other agreements, policies, or guidelines incorporated herein by reference, constitute the entire agreement between you and Radiology Jobs, LLC with respect to the subject matter hereof, and supersede all prior and contemporaneous agreements, understandings, negotiations, and representations—whether oral, written, or electronic—relating to the Website and Services.
20.2 Severability. If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be so modified, shall be struck, and the remaining provisions of these Terms shall continue in full force and effect.
20.3 No Waiver. Our failure to enforce any provision of these Terms or to exercise any right or remedy hereunder shall not constitute a waiver of that provision, right, or remedy, or of our ability to enforce it at a later time. No waiver of any obligation or right of either party shall be effective unless in writing and executed by the party against whom it is being enforced.
20.4 No Partnership or Agency. Nothing in these Terms shall be construed to create a joint venture, partnership, employment relationship, franchise, or agency relationship between you and Radiology Jobs, LLC. You are an independent contractor with respect to us.
20.5 Assignment. We may assign or transfer our rights and obligations under these Terms, in whole or in part, to any affiliate, successor, or acquirer without your consent. You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. Any purported assignment without such consent shall be null and void.
20.6 Headings. Section headings in these Terms are for convenience and reference purposes only and shall not affect the interpretation or construction of these Terms.
20.7 Admissibility of Electronic Records. A printed or electronic version of these Terms and of any notice given in electronic form shall be admissible in judicial or administrative proceedings to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
20.8 Compliance with Law. Our performance under these Terms is subject to existing laws and legal processes. Nothing in these Terms limits our right to comply with governmental, court, or law enforcement requests relating to your use of the Services or information we hold about such use.
20.9 Accessibility. We are committed to making our Website and Services accessible to users with disabilities. 20.10 Taxes. You are responsible for all applicable taxes, levies, and duties arising from your use of the Services, except for taxes based on Radiology Jobs, LLC’s net income.

Unless otherwise stated in these Terms, any notices or other communications required or permitted under these Terms shall be in writing and delivered: (a) by us to you via email to your registered email address or via posting on the Website; and (b) by you to us via email to [email protected] or by mail to Radiology Jobs, LLC, PO Box 5735, Thomasville, GA 31758. Notices are effective upon delivery.
20.12 Survivability. Sections 7 (User Content and Submissions), 10 (Intellectual Property Rights), 16 (Disclaimers and Limitation of Liability), 17 (Indemnification), 18 (Dispute Resolution), 19 (Governing Law and Venue), and 20 (Miscellaneous) shall survive the expiration or termination of these Terms and any cancellation of your Account.
